Litigation – Who is the owner?
The scenario is hardly unique. When we own property with another person – be it a jointly owned home, shared car or even a collection of vintage records, disputes can arise as soon as there is a breakup.
The question of who owns the
What happens when property ownership is disputed?
When it comes to property in the form of land including a company, the general starting point is that the owners will be registered either with the land registers or companies house. This can be problematic for silent partners or owners who have proceeded up until this point without formal recognition of their position.
It is important to protect your interests formally as even if the relationship doesn’t sour other things can happen. If you are an unmarried partner, friend or business partner – the sudden death of your partner could put people in control of your asset who do not recognize your status.
We can put you in touch with a Solicitor who can advise you on how you can protect your interest.
What about the property where no record of ownership is kept? This would include the above-mentioned vintage record collection. The property belongs to the person who bought it. That is the general starting point. This may be difficult enough but even for the person who meticulously recorded and kept receipts for everything they bought but this doesn’t mean problems can arise.
If another person claims you gifted them the property either formally or with a simple declaration that ‘its yours as much as mine’ can give rise to a legitimate claim of ownership for the person you said this to.
Disputed property can lead to long-lasting and costly legal battles which will leave both parties with less than they started. If you would like to discuss a disputed property matter, please contact free legal helpline today.
